2. What data we process and why

Famooze CommV processes personal data for the execution of photography assignments and the associated administration. Below is an overview per category.

2.2 Visual material

Photos of identified individuals are personal data. Famooze CommV processes visual material solely on the basis of explicit consent, recorded via a model release form signed before or after each shoot.

Consent for publication is always opt-in and is recorded via a separate model release form. You can withdraw consent at any time for future use via hello@rafaelbalrak-photography.com. Images already published cannot be withdrawn after revocation.

2.3 Website visitors

When visiting rafaelbalrak-photography.com, technical data may be processed (IP address, browser type, pages visited) via cookies and analysis tools. For more information, please refer to our cookie statement.

A Facebook Pixel is active on this website. This cookie is only placed after your consent via the cookie banner. The pixel sends anonymized behavioral data to Meta (Facebook) for advertising purposes. You can refuse or withdraw this via the cookie banner.

2.4 Contact form

Data you enter via the contact form (name, email, message) is used to answer your question and not for marketing purposes without explicit consent. Legal basis: legitimate interest (Art. 6.1.f GDPR). Retention period: 2 years after last contact.

3. Sharing with third parties

Famooze CommV does not share personal data with third parties for commercial purposes. Data is only shared in the following situations:

  • Processors providing services to Famooze CommV (Billit accounting software, email hosting, WordPress hosting). These parties act solely on behalf of Famooze CommV and may not use data for their own purposes.
  • Meta Platforms (Facebook/Instagram) via the Facebook Pixel — only after explicit cookie consent.
  • When a legal obligation requires it (e.g., at the request of a judicial authority).

Visual material is never sold or passed on to third parties without explicit consent.

4. Transfer outside the EEA

In principle, Famooze CommV does not transfer data outside the European Economic Area. Meta Platforms (Facebook Pixel) has servers in the US. Meta is certified under the EU-US Data Privacy Framework, which makes transfer to the US legally valid (Art. 45 GDPR).

Based on the GDPR, you have the following rights:

  • Right to rectification (Art. 16 GDPR) — you can have incorrect data corrected.
  • Right to erasure (Art. 17 GDPR) — in certain cases, you can ask for your data to be deleted.
  • Right to restriction of processing (Art. 18 GDPR) — you can ask to temporarily restrict the processing.
  • Right to data portability (Art. 20 GDPR) — you can request your data in a readable format.
  • Right to object (Art. 21 GDPR) — you can object to processing based on legitimate interest.
  • Right to withdraw consent (Art. 7 GDPR) — you can withdraw previously given consent (e.g., model release, cookies) at any time, without this affecting the lawfulness of previous processing.
